and local divisions of national corporations. Our services to these
clients include advice on choice of organization and preparation of
organizational documents to continuing assistance with legal aspects
of business operations.
Municipal and Public Sector
The firm has extensive experience in the full range of municipal law.
The firm has been counsel to the Town of Kernersville since 1976 and
has been counsel to other governmental entities on special projects.
We have expertise and over twenty-five years of experience in representation
of governing bodies, Planning Boards, Boards of Adjustment; drafting
Ordinances, land use Codes and Plans, and local Legislation; negotiating
and drafting Annexation and inter-local governmental Agreements, Developer
Agreements, developing Ordinance and Administrative Enforcement procedures,
Condemnation cases; Zoning, Subdivision and other Planning matters;
advising on purchasing and public body requirements, environmental
matters, employment and personnel matters, land use matters, and defending
annexation challenges and appeals.
Personal Injury and Wrongful Death
The firm assists clients who are seeking
compensation for injuries or death caused as a result of someone else’s
negligence.
Litigation
The firm assists Plaintiff and Defendant, individual and corporate clients,
in matters requiring civil litigation in all State and Federal courts.
Mediation and Alternative Dispute Resolution
The firm offers
mediation and other alternative dispute resolution services in both the
domestic/family law and general civil Superior Court areas. These
services can be chosen by parties to various types of disputes as an
alternative to costly litigation, or as a means of resolving matters
that are being litigated without the expense and trauma of a full trial
of the issues posed. In the domestic/family law area, both mediation
and arbitration are offered for a broad range of issues, including
equitable distribution (or division of marital property),
custody/mediation/child support, and related civil matters. In the
general civil Superior Court area, our certified mediator assists in the
resolution of numerous civil matters, including but not limited to
personal injury, contract, business and farm dispute matters. The
firm’s mediator is certified in both the domestic/family law area and
the civil Superior Court area by the North Carolina Dispute Resolution
Commission.
Real Estate
The firm assists everyone from the first-time home buyer to the corporate
client involved in complex real property transactions. Services we
offer include drafting of deeds, Notes, Deeds of Trust, and other real
property documents; closing attorneys for residential purchases, including
loan transactions; developer representation for subdivision development
including negotiations, property acquisition, appearance for rezoning
matter, and preparation of protective covenants, and coordination of
all facets of real property development; preparation of commercial
leases, shopping center leases, option agreements, release agreements,
and related transactions.
Estate Administration & Estate
Planning
The firm provides assistance to individuals
in need of assistance in the administration of Estates as well as those
desiring estate planning services including assisting Administrators,
Executors, and Guardians in all aspects of estate administration and
preparation of estate planning documents including Wills, Trusts, Powers
of Attorney, Health Care Powers of Attorney, Living Wills, and related
documents.
Criminal and Traffic
The firm maintains an active practice in the State District and Superior
Courts. The services provided by the firm include Court representation
of persons cited for both minor and more serious traffic and criminal
law violations and charges.
Miscellaneous Matters
Some of the other areas within which the
attorneys of the firm represent clients include Social Security disability
claims, appeals of State Agency actions or determinations, appearances
before, and negotiations with, governmental and quasi-governmental officials
and organizations, defense of various miscellaneous civil actions, and
appeals of lower court decisions.
